A summons from the Directorate of Enforcement is a legal obligation, not an invitation. How a person responds in the first two days often shapes the rest of the investigation.
Understand your status
The summons may be addressed to a witness, to someone whose role is still being examined, or to a person already named. The answer affects what should be said, what documents should be carried and what protection should be sought.
Statements carry weight
Statements recorded under the PMLA are treated differently from statements to the police. They should be given with care, accurately, and after preparation with counsel.
Protective remedies
Depending on the facts, remedies may include anticipatory bail, challenges to coercive action and representations on attachment. Each has its own forum and timing.
Corporate summons raise additional questions — board communication, document preservation and parallel regulatory exposure — that should be coordinated from the outset.
