Disputes Resolution

Arbitration From clause to enforcement.

Overview

Cross-border disputes, institutional & ad hoc arbitration

Discuss your matter

Domestic and international arbitration, handled end to end by one firm that understands both the procedure and the commercial stakes.

We draft the clause that will govern the dispute years later, secure urgent interim protection, run the reference before the tribunal, and see the award through challenge and enforcement — in India and abroad.

Key highlights

§9

Interim relief

Court-ordered protective measures before, during or after the arbitral proceedings.

12

Months

The statutory timeline for a domestic award from completion of pleadings, extendable by six.

Part II

Foreign awards

Recognition and enforcement of New York Convention awards in India.

How we approach this work

01

Research-driven.

We read the clause, the seat and the enforcement map first — where the assets are decides how the reference should be run.

02

Client-centric.

We keep business leaders briefed in plain language at every procedural step, so decisions stay with the business.

03

Result-oriented.

An award is only worth what can be enforced; we build the record, and the interest claim, with the challenge stage already in view.

How we help

What the work involves.

Clause & strategy

Advising on dispute strategy, arbitration clauses, jurisdiction, applicable law and forum selection — the most effective approach to protecting commercial interests.

Interim relief

Representing clients in proceedings for interim, protective and emergency measures, including preservation of assets, evidence and other urgent relief.

Appointment

Assisting with the appointment and challenge of arbitrators, constitution of tribunals and procedural strategy before domestic and international institutions.

Hearing & award

Representation throughout the proceedings — pleadings, claims and counterclaims, documentary and witness evidence, written submissions, oral hearings and final arguments.

Challenge & enforcement

Setting aside, recognition and enforcement of domestic and foreign arbitral awards, including execution.

The pathway

Step by step.

  1. Before & during the proceeding

    • Arbitration clauses and dispute-resolution frameworks
    • Statements of claim, defence and counterclaim
    • Presenting evidence and witnesses at hearings
  2. After the award

    • Applications to set aside an award
    • Enforcement of domestic and foreign awards
    • Appeals and execution proceedings

Questions & answers

What clients ask us.

How long do I have to challenge an arbitral award?

An application under Section 34 of the Arbitration and Conciliation Act must be filed within three months of receiving the award, with a further 30 days available only on sufficient cause. The window is strict.

Institutional or ad hoc — which is better?

Institutional arbitration brings administered timelines and a secretariat; ad hoc offers flexibility and lower fees. The right choice depends on the value, the counterparty and where enforcement will happen, which is why we advise at the clause stage.

Can a foreign award be enforced against assets in India?

Yes. Awards from New York Convention countries notified by India are enforceable under Part II of the Act, subject to the limited grounds of refusal in Section 48.
