Rebranding after launch is expensive. An injunction in a passing-off or infringement action can force it overnight.
Search beyond identical marks
Similar marks in related classes, phonetic equivalents and well-known marks across classes can all block a new brand. A proper search looks at all of them, and at common-law use.
File early, file correctly
India follows a first-to-file system subject to prior use. Filing in the right classes, with an accurate user claim, avoids objections that delay registration.
Where a conflict is found, there are often options short of abandoning the brand — coexistence agreements, a modified mark or a narrower specification.
